WILMINGTON, Del.--(BUSINESS WIRE)--More than three years after completion of the unprecedented forced sale of TransPerfect, Chancery Court-appointed Custodian Bob Pincus from Skadden Arps and Skadden partner Jennifer Voss continue to threaten ongoing litigation and costly legal proceedings rather than simply accepting the money paid to them.
A recent letter from Voss to TransPerfect’s lawyers indicates that Skadden has refused to cash a more than $1.1 million payment made on behalf of the firm for outstanding debts owed due to unfounded accusations of “bad faith” and procedural hairsplitting.
Said Citizens for a Pro-Business Delaware Campaign Manager Chris Coffey, “Skadden is facing an easy choice – cash the check already in their possession from TransPerfect and pay themselves, or nitpick and fight at every turn. It seems that Custodian Bob Pincus and his attorney Jennifer Voss are so accustomed to running roughshod through the Delaware courts that they are opting for the latter.
“Already, Skadden and its advisors have charged TransPerfect an obscene $50 million-plus throughout the course of its custodianship, yet the firm continues to contest every procedural step as if the legal system will come crashing down if they receive money via a check rather than a wire. Only in Delaware would a well-connected law firm feel so entitled to reject a $1.1 million payment on procedural grounds rather than simply paying themselves.
