Patent Infringement Suit Dismissed in Favor of Sonitor

CenTrak Agrees to No Further Suits on Its Principal Patent

GREENWICH, Conn.--()--Sonitor Technologies, the global leader in ultrasound-based Real-Time Location Systems (RTLS) and Indoor Positioning Systems (IPS), won dismissal of a patent infringement suit filed by CenTrak, Inc. in 2014. In the September 20 dismissal order, CenTrak further agrees that it will not sue or threaten to sue Sonitor, or any of Sonitor's resellers, partners, customers, or users, for any claim of infringement, whether past or future, of CenTrak’s U.S. Patent No. 8,604,909 (’909 Patent).

We are pleased with this result and will continue to vigorously defend, in all fora, allegations of patent infringement,” said Anne Bugge, President and CEO of Sonitor Technologies, Inc. “Our ultrasound-based Real-Time Location Systems (RTLS) remain unique, and our widespread customer base realizes these systems perform far better than infrared or radio frequency technologies.”

In August 2017, the U.S. District Court in Delaware ruled that the ’909 Patent was invalid and not infringed by Sonitor. CenTrak appealed on procedural grounds and that decision was remanded to the District Court, which then dismissed the case. A recently-filed second action by CenTrak alleging infringement of three subsidiary patents, all of which are based on the ’909 patent, remains pending. Sonitor asserts that these patents are similarly invalid and not infringed. Sonitor has also asserted multiple counterclaims against CenTrak.

We are confident that we will prevail in CenTrak’s second, belated, attempt to achieve in the courts what it cannot achieve in the marketplace, where the Sonitor system offers unique and innovative solutions for customers’ needs,” added Bugge. “CenTrak has litigated against Sonitor for five years with no result because Sonitor is the real innovator in this space.”

Sonitor is represented by Morris, Nichols, Arsht & Tunnell, in Wilmington, Delaware, and Sterne, Kessler, Goldstein & Fox P.L.L.C. in Washington, D.C.
