RENO, Nev.--(BUSINESS WIRE)--Battle Born Munitions (BBM), a leading broker, exporter, importer and manufacturer of defense solutions, today invites suppliers and manufacturers for Dick’s Sporting Goods, Inc. (NYSE: DKS) who have experienced late or delayed payments or have been forced into arbitration to reach out. BBM CEO Fred Hees is asking any and all suppliers, regardless of contract terms who have been victims of breached contracts and Dick’s poor business practices, to come forward as they may have common claims against Dick’s.
BBM is currently involved in a lawsuit against Dick’s for Breach of Contract, Fraudulent Inducement and Negligent Misrepresentation. BBM is seeking to recoup approximately $5.5 million in damages stemming from a 2016 contract between Dick’s and BBM.
The lawsuit states that Dick’s Sporting Goods placed a large order for its house brand ‘Field and Stream’ ammunition, which BBM filled by the end of November 2016 as outlined in the contract. Dick’s refused to take delivery on the order, thus forcing BBM to store the merchandise at its cost and tying up capital that was needed for other contracts BBM had in place. In addition, Dick’s delayed payments and took discounts on invoices, which were outlined in the contract as incentive for early payment, that they were not entitled to.
Ultimately, BBM was prevented from executing lucrative contracts with other vendors that resulted in the loss of those contracts as well as categorically damaging BBM’s otherwise sterling reputation.
“The way our contract was executed did not keep with the original letter of the agreement and I do not believe that our experience with Dick’s is an isolated incident. We feel strongly that their behavior could be indicative of larger financial issues,” said Hees. “We were shocked and surprised that a retailer of the caliber of Dick’s would engage in these practices and fail to honor the terms of a contract. Our concern now is that we are just one supplier in a long line of suppliers who have been defrauded by Dick’s and that there may be others who have been materially harmed. We are seeking to open a pathway for other companies in our position to come forward and help us put an end to Dick’s unscrupulous and predatory business practices.”
Earlier this year a federal judge in Pittsburgh denied Dick’s recent motion to dismiss and the lawsuit will be heard in federal court later this year.
