Lawsuit Alleges Woman Died from Ovarian Cancer After Using Talc Product

OAKLAND, Calif.--()--Gibbs Law Group and the Seattle-based Corrie Yackulic Law Firm have filed a California lawsuit against Johnson & Johnson alleging that the company failed to warn consumers that the frequent use of talcum powder posed a grave and significant health risk to women of developing ovarian cancer.

The lawsuit alleges that the defendants were aware, based on numerous scientific studies, that the use of talc products may increase the risk for developing ovarian cancer, but failed to warn consumers and the public of the known health hazard. The complaint also alleges that Johnson & Johnson engaged in deceptive and misleading marketing campaigns regarding the safety of its talc products for regular use for women as part of their feminine hygiene routines.

Lilia Duràn was employed as a field worker in Live Oak, California, and used talcum powder on a daily basis to combat sweating and rashes. She was diagnosed with ovarian cancer at the age of 52, and despite surgery and other treatments efforts, Lilia succumbed to her illness two years after her diagnosis. Lilia is survived by her husband and three children.

“Lilia Duràn’s case is a tragic example of the grave harm that can result to women who used talcum powder for daily hygiene, which they understood to be completely safe,” said Corrie Yackulic, one of the counsel for Ms. Duràn’s surviving family.

“Drug manufacturers have an obligation to provide consumers with the information they need to make informed decisions about the products they use,” said Karen Menzies, one of the lead attorneys litigating the case. “Johnson & Johnson deliberately deprived people of that choice, touting the safety of talcum powder to women, while having scientific knowledge that the products increase the risk of ovarian cancer.”
