AHF Commends Cal/OSHA for Citing & Fining Porn’s James Deen $78K for Condom & Safety Violations

Group also praises Cal/OSHA for public statement in February after Cal/OSHA’s Standards Board meeting clarifying the fact that condoms are—and remain—required in all adult films made in California.

LOS ANGELES--()--AIDS Healthcare Foundation (AHF) today praised Cal/OSHA for citing and fining adult film’s James Deen Productions’ Third Rock Enterprises Inc. nearly $78,000 “…for multiple violations of state condom and other safety laws which exposed performers to sexually transmitted infections and illnesses.” Cal/OSHA opened an investigation of Deen and his production company on December 8, 2015 after several rape accusations were lodged against the performer—including several by other performers he had worked with—and after workplace safety complaints were filed with OSHA by AHF over Deen’s lack of condom use in his productions. The OSHA citations and fines came about as a direct result of AHF’s safety complaint.

“We want to thank Cal/OSHA for acting so swiftly on our workplace safety complaint against James Deen Productions and Third Rock by citing and fining Deen, one of the industry’s most well-known producers and adult performers—and the one who is the most vocal critic and prominent public face of the industry in its opposition to condom use,” said Michael Weinstein, President of AIDS Healthcare Foundation. “We also want to recognize and thank Cal/OSHA once again for its unambiguous press statement of February 19th reminding the industry as well as the media of the fact that condom use is—and very much remains—required in all adult film production in California.”

After Cal/OSHA’s Occupational Safety & Health Standards Board failed to adopt an amendment to the Bloodborne Pathogens Standard (Title 8 Section 5193) to update the Standard specific to the adult film industry at its February 18th meeting in Oakland, many news outlets and adult industry performers and bloggers incorrectly reported that OSHA had voted down condoms in porn.

In fact, then as now, condom use in adult film production remains the law of the land in California and elsewhere.
