The complaint accuses the defendants of violations of the Securities Exchange Act of 1934 by virtue of the defendants’ failure to disclose during the Class Period that fewer patients were available for primary endpoint evaluation in the Phase III Study, that the data from 72 patients of the Phase III Study was compromised, that XBiotech did not adequately sample patients to accommodate data loss, and, as a result of not properly sampling patients for the Phase III Study, the Phase III Study would have reduced statistical power to demonstrate the proposed outcome.

According to the complaint, following the Company’s November 23, 2015 disclosure of this information, the value of XBiotech shares declined significantly.
