In the complaint, the defendants are alleged to have violated certain provisions of the Securities Exchange Act of 1934. Specifically, the complaint alleges that defendants’ misrepresented and/or failed to disclose that: a) BioScrip improperly distributed the product Exjade through its specialty pharmacy operations; b) a considerable portion of BioScrip’s revenues were gained through the violation of federal and state laws and regulations; and c) as a result of the above, BioScrip’s statements were materially false and misleading at all relevant times. According to the complaint, BioScrip’s stock price dropped dramatically after the true facts were revealed.
