LOS ANGELES--(BUSINESS WIRE)--Hobart Linzer LLP announced the firm has obtained a preliminary injunction prohibiting Wildfox Couture, LLC and Michelle Siwy from infringing Siwy Denim’s federal trademark rights, and using the term “Siwy” in connection with any denim apparel advertised, marketed, promoted, manufactured or sold by Wildfox. The signed court order is dated Friday, Oct. 11, 2013.
“This is an important victory for our client Siwy Denim as they seek to protect their federal trademarks,” said Hobart Linzer co-founder Kenneth A. Linzer who credited Amy Duncan of the firm as instrumental in obtaining the injunction. “As stated in the court order, it is ‘undisputed that the three trademarks in question are registered to Siwy Denim.’ This injunction protects Siwy Denim from additional harm as this process continues.”
Beginning in Spring 2013, Wildfox Couture, LLC and Michelle Siwy (the former Creative Director of Siwy Denim, Inc.) began a social media campaign advertising a line of denim apparel in which the Wildfox Parties made infringing uses of Siwy Denim’s trademarks containing the term “Siwy.” Siwy Denim sued the Wildfox Parties in July 2013 for trademark infringement. Siwy Denim asked the Los Angeles Superior Court (Hon. Suzanne Bruguera) to issue a preliminary injunction prohibiting this continuing trademark infringement by the Wildfox Parties.
On Oct. 9, 2013, the court granted Siwy Denim’s request finding that Siwy Denim had demonstrated that it was likely to succeed on the merits of its trademark infringement claims against the Wildfox Parties.
