Bailey & Greer Secures $3.7 Million Jury Award for Disabled Trucker

Funds Compensate Hard-Working Driver for Losses of Earnings, Earnings Capacity, Enjoyment of Life and Also Present and Future Medical Expenses

MEMPHIS, Tenn.--()--A Shelby County Circuit Court jury has awarded $3.7 million to Donriel A. Borne for injuries he sustained when the 18-wheeler he was driving was struck from behind by another big rig on I-55 in Memphis.

The jury verdict against Celadon Trucking Services, Inc., of Indianapolis followed a contentious two-week trial before Judge Robert S. Weiss in Shelby County Circuit Court Division 8.

R. Sadler Bailey and Thomas R. Greer of Bailey & Greer, PLLC represented Borne, 34, of Atlanta, who was at the time of the accident a driver for Trimac Transportation South, Inc.

“The jury spoke powerfully and held Celadon accountable for the life-changing injuries that prevent our client from returning to work,” said Greer. “This unanimous verdict and the significant award reflect what members of the jury determined was just and fair after their thoughtful deliberations.”

The decision to take the case to trial was made, Greer said, after attempts to resolve the matter through negotiation and mediation were unsuccessful following a defense offer of $25,000. The jury award verdict was announced May 30.
