U.S. Court of Appeals for the Federal Circuit Court Upholds Cummins Allison Patent Infringement Lawsuit against SBM Co., LTD and Amro-Asian Trading Company

MT. PROSPECT, Ill.--()--Cummins Allison, the leading innovator and provider of coin, check and currency handling solutions, announced today that the United States Court of Appeals for the Federal Circuit in Washington, D.C. entered a judgment in favor of Cummins Allison Corp. against appellants SBM Co., Ltd. (formerly Shinwoo IT Co., Ltd.) and Amro-Asian Trading Company. The decision affirmed a 2009 Federal Court decision in which a jury returned a unanimous verdict of patent infringement, against each defendant, with respect to currency denominating and authenticating products designated SB1000, SB1000+, SB1100 and SB1800.

In addition to affirming the District Court holding that the appellants had infringed multiple claims of two United States Patents owned by Cummins Allison, the Federal Circuit upheld a damage award of approximately $13 million and reversed the lower court’s ruling that an asserted claim of a third Cummins Allison patent was invalid.

“We are very pleased with the Federal Circuit’s recognition and affirmance of the hard work of Judge Clark and the Beaumont jury. The U.S. court system has again validated the merits of the Cummins Allison intellectual property portfolio. It is humbling to be a central figure in this important demonstration of the influence which IP protection has on the stimulation of technology development and the creation of American jobs,” said William Jones, CEO, Cummins Allison.

Cummins Allison was represented on the appeal by Winston & Strawn, LLP and Nixon Peabody LLP of Chicago, Illinois.
