Compliance Poster Company Discovers Four Mandatory California Labor Law Posting Changes

LOS ANGELES--()--In what has been described as the most active legislative session in years, the state of California will release up to four (4) mandatory-to-post labor law changes. The Legal Research Team at Compliance Poster Company discovered these changes while reviewing the assembly bills and senate bills passed by the state of California.

California legislators have been busy this year during Governor Brown’s first full year back in office. He has signed many important labor laws that affect CA employers, some of which require immediate updates to mandatory workplace posters. These labor law posters must be displayed in the workplace for employees to view.

Confirmed Mandatory California Changes:

  • Discrimination and Harassment in Employment are Prohibited by Law poster
  • Notice A Pregnancy Disability Leave poster
  • Notice B Family Care and Medical Leave (CFRA Leave) and Pregnancy Disability Leave poster

The California Discrimination notice will have a mandatory change per CA Assembly Bill 887 & CA Senate Bill 559. The state added Gender, Gender Identity, and Gender Expression to the list of protected classes on the Discrimination notice, effective 1/1/2012.

On the California Pregnancy Disability Leave Notice A poster, the revised notice now states the following: “The FEHA prohibits us from denying, interfering with, or restraining your exercise of these rights. If we currently provide and pay for your coverage under a group health plan, we must continue to do so while you are on PDL. If we do not already provide health insurance, we are not required to begin doing so when you take PDL.” This version of the notice must be posted by 1/1/2012, as a result of CA Assembly Bill 592 & CA Senate Bill 299.

Finally, the California Leave Notice B has been revised (per CA Assembly Bill 592 & CA Senate Bill 299) to include the following statement: “The CFRA prohibits us from denying, interfering with, or restraining your exercise of these rights.” This notice must also be posted by January 1, 2012.

A potential fourth revision could be released as a result of significant legislative changes to mandatory employee notification of California’s workers’ compensation laws (CA Assembly Bill 335) which should result in forthcoming required notice updates.
