SAN FRANCISCO--(BUSINESS WIRE)--The law firm of Girard Gibbs LLP (www.GirardGibbs.com) has teamed up with Military Connection (www.MilitaryConnection.com) to investigate service members’ reports that certain creditors and lenders are improperly denying them their legal rights under the Servicemembers Civil Relief Act (SCRA).
Under the Servicemembers Civil Relief Act (SCRA), military personnel may be able to obtain a 6% cap on interest rates for debts incurred before they began active duty. The interest rate cap applies to a variety of debt types, including credit card debts, car loans, mortgages, and student loans. The law also applies the 6% cap to service charges and other fees, and shields active duty military from foreclosures. In order for the SCRA protections to trigger, the service members must file a written request with their lender, and provide their active duty military orders.
“The financial and credit protections included in the SCRA were specifically created to relieve active duty military personnel and their families from worries about financial and legal problems back home so they can devote their full attention to defending this country,” said Debbie Gregory, CEO of MilitaryConnection.com. “Many of our military service members are being improperly denied their rights under the Servicemembers Civil Relief Act.”
“Active duty military personnel need to understand their rights under this law,” said attorney Dylan Hughes of Girard Gibbs LLP, “Lenders who violate the law must be held accountable for their actions.”
