BEVERLY HILLS, Calif.--(BUSINESS WIRE)--Cape Verde Pershing Bay, LLC and Sonny Astani, the CEO/founder of Astani Enterprises, have filed a lawsuit in Miami-Dade County Court, Eleventh Judicial Circuit, against Ft. Lauderdale-based Ferretti Group of America.
In the lawsuit, Astani’s Delaware-incorporated Cape Verde Pershing Bay, LLC, claims that yacht-maker Ferretti twice delivered yachts with numerous deficiencies and then refused to return $2,750,000 that Astani had advanced to Ferretti for delivery of a yacht that Astani had been guaranteed would be in working order. The case is Cape Verde Pershing Bay, LLC vs. Ferretti Group of America, LLC; local case number 2017-018517-CA-01.
Astani alleges that in 2015 he purchased a 2015 Pershing 62-foot luxury yacht from Ferretti for $2,750,000. However, months later, Astani was unable to use the vessel, and had to return it to Ferretti for overheating problems in the starboard engine; problems that subsequently could not be rectified, according to the lawsuit. In exchange, Astani agreed to use his entire Pershing purchase price as a credit toward the nearly $5 million purchase of a new 2016 Riva Perseo 76’ from Ferretti.
According to the lawsuit, the Riva Perseo had multiple deficiencies as well, including a bizarre flat dashboard LED screen, which made it impossible to view the navigation instruments under the sun light. Ferretti was months late to deliver the vessel, according to the lawsuit, and Astani finally cancelled the purchase agreement. Ferretti, while in possession of both vessels, has insisted on keeping Astani’s $2,750,000 advance fee pursuant to what Ferretti claims are “liquidated damages.” Astani is now seeking a return of his funds.
