BOTHELL, Wash.--(BUSINESS WIRE)--EagleView Technology Corporation (“EagleView®”), a leading technology provider of aerial imagery, data analytics and GIS solutions, is encouraged by recent developments in its ongoing litigation against Xactware and Verisk for infringement of EagleView’s patents. The case began in late 2015 when EagleView filed a lawsuit against Xactware Solutions, Inc. (“Xactware”) and Verisk Analytics, Inc. (“Verisk”) for willful infringement of EagleView patents covering key technologies related to its roof measurement products.
The lawsuit is currently in the United States District Court for the District of New Jersey, titled EagleView Technologies, Inc. and Pictometry Int’l Corp. v. Xactware Solutions, Inc. and Verisk Analytics, Inc., case number 1:15-cv-07025. As part of that case, EagleView will ask a jury to award it damages for Xactware and Verisk’s patent infringement and will ask a Court to order Xactware and Verisk to stop making, using and selling their aerial rooftop products.
As part of the litigation, Xactware and Verisk have filed a number of challenges against EagleView’s patents with the Patent Trial and Appeal Board (PTAB) for the United States Patent & Trademark Office (USPTO). These challenges, known as requests for inter partes review (IPR), question the validity of patents in light of prior art shown to the USPTO.
Recently, the PTAB denied institution of five of Xactware and Verisk’s requests for inter partes review filed by Xactware and Verisk. The IPRs denied were:
- IPR2016-01775, attempting to invalidate EagleView U.S. Patent No. 8,078,436, titled “Aerial Roof Estimation Systems and Methods”;
- IPR2017-0021, attempting to invalidate EagleView U.S. Patent No. 8,078,436, titled “Aerial Roof Estimation Systems and Methods”;
- IPR2017-0025, attempting to invalidate EagleView U.S. Patent No. 8,818,770, titled “Pitch Determination Systems and Methods for Aerial Roof Estimation”;
- IPR2017-0027, attempting to invalidate EagleView U.S. Patent No. 8,825,454, titled “Concurrent Display Systems and Methods for Aerial Roof Estimation”; and
- IPR2017-0034, attempting to invalidate EagleView U.S. Patent No. 8,209,152, titled “Concurrent Display Systems and Methods for Aerial Roof Estimation.”
These decisions follow prior PTAB rulings that have been in EagleView’s favor. While the PTAB is still considering some of Xactware and Verisk’s challenges, these rulings from the USPTO confirm that this case will move forward towards trial without further interruption.
