Recent Legislation Impacting EHRs
- Mandatory Electronic Prescribing: 2 states have mandated electronic prescribing for controlled substances (EPCS) and others have introduced legislation for eRx mandates.
- Prescription Drug Monitoring Programs: 26 states now require prescribers to check PDMPs and 3 have proposed legislation to require the State to make access available to prescriber systems (via EHRs). One state has made the bold move of requiring all prescriptions, including non-controlled substances, to be submitted to the PDMP effective January 2018.
- Opiate Dispensing Notification: 1 state has passed legislation that places new limits on prescriptions for opiates and requires pharmacies to notify prescribers when a lesser amount is dispensed versus what was prescribed.
- Biosimilars: 19 states have enacted legislation requiring physicians to be notified via their EHRs when a biosimilar substitution is made – and 8 more have pending legislation.
