Cave Consulting Group, Inc. Prevails In Numerous Patent Infringement Disputes With OptumInsight, Inc.

SAN MATEO, Calif.--()--CCGroup is pleased to announce that it has prevailed on many of the patent infringement claims asserted against it by OptumInsight (formerly Ingenix, Inc.). OptumInsight’s claims of infringement for 6 of its 8 asserted patents, which pertained to grouping medical claims data into episode treatment groups (“ETGs”), have been dismissed by the court and cannot be reasserted. “OptumInsight has acknowledged that CCGroup has prevailed against the Symmetry ETG portfolio of patents,” stated Dr. Douglas G. Cave, President of CCGroup. Two OptumInsight patents, which expire next year, remain in suit. For the same reasons OptumInsight has dismissed a majority of its patent claims, CCGroup is confident that it will prevail on OptumInsight’s remaining claims asserted against the Cave Grouper™.

CCGroup is equally confident that Optum’s Impact Intelligence product will be found to infringe CCGroup’s U.S. Patent No. 7,739,126 (the “’126 patent”), which expires in 2028 and pertains to calculating physician efficiency scores. The ‘126 patent protects CCGroup’s novel approach to analyzing physician efficiency using medical condition episodes-of-care built from any grouper (not just the Cave Grouper™) using a predefined set of medical conditions for a specialty type,” and weighting these medical condition episodes-of-care using direct or indirect standardization to calculate an overall physician efficiency score. CCGroup has invested significant time and effort to determine and develop the most appropriate methods to obtain reliable and stable physician efficiency scores. These patented provider efficiency analytics and statistics allow our health plans and physician group clients to obtain accurate and reliable efficiency scores—something that has been elusive to date for those who do not use CCGroup’s patented methodology.

The case is No. 5:11-CV-0469-EJD and is currently pending in the United States District Court for the Northern District of California in San Jose.
