Eltek Sues East UPS For Intellectual Property Infringement

After abandoning settlement negotiations on alleged utilization of illegally acquired Eltek product documentation, Eltek now returns to court against East UPS

DRAMMEN, Norway--()--Eltek, the world leader in high efficiency power systems, today announced it has abandoned settlement negotiations and has returned to court in China in its suit against East UPS for infringement of intellectual property.

“Eltek´s world-class technology is a unique asset, and we do not accept infringement of our intellectual property rights. Without exception, we will pursue any infringements now or in the future,” says Morten Schøyen, Marketing Director of Eltek.

Eltek discovered products from East UPS that were suspiciously similar to Eltek products after being alerted by an Eltek supplier in China 18 months ago. After acquiring products and analyzing them, Eltek believes that the East UPS products were based upon production documents and software illegally copied from Eltek. The alleged sources were former Eltek employees who later worked for East UPS.

“Our evidence in this case is overwhelming. The software can be proven to be direct copies of Eltek software. Component specifications and product designs are obvious copies and even the user documentation is a scanned copy with the Eltek logo replaced by that of East UPS,” Schøyen said.

Despite Eltek's belief of clear proof, the company agreed with the Chinese court to pursue settlement negotiations.

“We entered a dialogue to settle outside court with, in our view, very favorable terms for East UPS considering their position. When they decided to decline our offer, which we have amended in several rounds to come to an agreement, we had no other choice than to go to court. Eltek believes in the Chinese legal system and its ability to strike down these kinds of illegal activities,” Schøyen said.
